TERMS & CONDITIONS


These terms and conditions are a legal agreement between Tina Pearson Salon, LLC (Company)  and you ("Ambassador"). By signing up to be an ambassador in the Tina Pearson Ambassador Program ("program") you agree to be bound by the following terms and conditions. Please ensure that you read them carefully before signing up.


Definitions:


Agreement - the contents of the contract between Company and the Ambassador in respect to the Program

Program - The Ambassador Program as set out on the Site and is governed by this Agreement

Ambassador - Party who agrees to take part in the Program

Link - a HTML link provided to the Ambassador to link the Ambassador’s website to the SiteSite - shoptinapearson.com website

  1. The Agreement

1.1. An Ambassador must provide full legal name, valid address, e-mail address and any other information requested in order to create an Ambassador account.

1.2 An Ambassador must provide a valid PayPal address or required bank account information upon registration to receive commission payments.

1.3. Company reserves the right to update and change the Terms from time to time without notice.

1.4. Any modifications or changes to the Program shall be subject to these terms.

1.5. You may not use the Program for any illegal or unauthorized purpose. Violation of these terms and conditions may result in suspension of your rights to be an Ambassador and result in lost commissions and/or removal from the Program.


  1. Modification of Ambassador Program terms and conditions

Company reserves the right to modify or otherwise change the terms of the agreement at anytime. In the case of any modifications of the terms and conditions in this agreement, it is up to the ambassador to stay updated on the terms of this agreement as Company may change terms without notice from time to time. If the ambassador doesn't accept any modification, the ambassadors option is to end the agreement.

  1. Ambassador account

In order to enter the Company Affiliate network, the ambassador needs to create a log-in and password. From this account the ambassador is able to track and view sales, and receive commission payments.


  1. Legitimate methods of advertising

4.1. Ambassadors are permitted to use links, discount codes, any related banners, or tex tadvertisements provided by Company Ambassador program.

4.2. Ambassadors are not permitted to promote any non-ambassador program related materials,such as coupon codes provided in customer newsletters, codes provided to other ambassadors, any promotional codes, or codes received from any source other than directly from the Company Ambassador Program.

4.3. The promotion should include the offer, discount code, link provided by Company Ambassador Program and expiration date.

4.4. Ambassadors must remove invalid codes and banners.

4.5. Ambassador coupon codes and links are not to be promoted on third party websites such as coupon databases.

4.6. Ambassadors are permitted to promote their coupon code and link on their personal social media platforms only and must not share this information on any Company social pages.

4.7. Please note it is strictly forbidden to use Company’s trademark and your ambassador link any paid advertising channels.

4.8. Any sales that have been generated through improper promotion, will result in loss of commission.

4.9. Ambassadors may not advertise any other textured hair brand or salon whilst enrolled in the Company Ambassador Program. Should the ambassador wish to advertise another brand of textured hair products or salon, the ambassador is responsible for ending the partnership with Company by sending an e-mail. Should Company find that the ambassador is promoting another brand of textured hair products or salon during the Ambassador term with Company without receiving prior notification by email, this may result in suspension of your rights to be an Ambassador and result in lost commissions and/or removal from the Program.

4.10. Company reserves the right to take legal action against Ambassador that commits fraud.

4.11. Ambassador codes will be changed on a frequent basis and ambassadors will be contacted with their new code. All old codes must be removed and replaced with the new discount code.


  1. Copyrighted material

Ambassadors are responsible for ensuring that product descriptions and images comply with all applicable copyright, trademark, data protection, any intellectual property right or any other applicable law. Company will not be responsible if an ambassador uses another party's copyrighted material in violation of law.


  1. Payments

6.1. Ambassadors receive a commission for sending authorized sales via links provided by Company Ambassador Program. The customer must make a purchase by clicking the link on ambassador’s website within 30 days of the initial click-through.

6.2. The commission is based on product that is sold.

6.3. Payout rates may be changed and they can be viewed by logging into ambassador’s account.

6.4. It is the ambassadors responsibility to determine if the payout for the link provided has been discontinued.

6.5. The commission is paid only on links that can be tracked and reported by Company Ambassador Program systems. In order for systems to track the referral, the customer must have cookies enabled.

6.6. Refunded payments do not qualify for commission fee.

6.7. Payments may be revoked in the instance that a code is leaked on third party websites. It is the ambassador’s responsibility to ensure their code is not leaked.


  1. Company Obligations

Company agrees to undertake the following obligations:

7.1. Providing the ambassadors with promotional material, such as links, coupon codes, banners and any other graphic materials.

7.2. Processing all orders for Company products placed by following the ambassador’s link.

7.3. Tracking the amount of sales generated through the ambassador’s link and all social media content via tags and mentions

7.4. Payment processing, cancellations, returns and other related customer service for Company for the purpose of business.


  1. Ambassador Obligations

8.1. Ambassadors are required to post one piece of unique, original content, on their social media platforms on a monthly basis.

8.2. One piece of content can include the following items: Instagram feed post, Instagram reel,Instagram stories (4+ frames), Youtube video (review, get ready with me/date night, hairtutorials), TikTok feed post. Detailed Ambassador Program content requirements here.

8.3 Instagram content must tag @shoptinapearson, @tinapearsonsalon, and @thetinapearson and on the photo and in the caption and #tinapearsonhairpartner in the caption in order for Company to track the content. TikTok content must tag @tinapearsonsalon and #ltinapearsonhairpartner in the caption in order for Company to track the content. Youtube content must link back to the Company website and be emailed tinapearsonmarketing@gmail.com to track the content.

8.4. Ambassadors must be following @shoptinapearson, @tinapearsonsalon, and @thetinapearson on Instagram, TikTok and YouTube.

8.5. Failure to follow ambassador obligations may result in ambassador content being overlooked and potential removal from the program.

8.6. If ambassadors are unable to complete content, they may contact the Company Ambassador Program Coordinator, via email at tinapearsonmarketing@gmail.com, for assistance and provide reasoning.

8.7. Ambassador removal will take place if the ambassador fails to oblige with content requirements set forth in this agreement. 


  1. The License

9.1. Company grants to the ambassador a non-exclusive, non-transferable, revocable right to access Company site through the link in accordance with the terms of this agreement and in connection with the promotional materials provided and authorized by Company.

9.2. Company can use content created on social media platforms, websites, ads. Ambassador will always be credited.

9.3. Ambassadors cannot modify or change any materials provided by Company in any way.

9.4. Both parties agree not to use other's materials in any manner that is misleading, disparaging or in any way portrays the party in a negative light.

9.5. Any inappropriate use of the promotional material may be cause for immediate termination of the agreement.



  1. Liability 

Company will not be liable to the ambassador for the defects in the service, interruptions in the accessibility to the service, loss of data on the information handling system or viruses, loss of profits, loss caused by any third party deleting, removing, deactivating or tampering with the ambassador tracking service or other consequential loss of whether arising from neglect orbreach of contract.


  1. Termination

The term of the agreement starts upon Company Ambassador Program acceptance of ambassador’s application and can be terminated by either party. Affiliation can be ended with or without cause at any time, by giving the other party notice of termination in the form of e-mail. Upon the termination of the agreement, the ambassador will remove all links to Company website, as well as all banners and graphic images provided under the program.


  1. Confidentiality

Company Ambassadors are not permitted to disclose any information publicly regarding Comapny products, launches, or campaigns prior to being announced by Company.

We highly value our customers and their privacy. Our privacy policy is to respect and protect the privacy of our customers. Your personal information is safe with us. All personal information collected on this site is kept strictly confidential and not sold, reused, rented, disclosed, or loaned. Your personal information is used exclusively for the purpose of fulfilling your order and making your buying experience a success. Company ("Company", 'we', 'our', 'us') respects the privacy rights of its online visitors ('you', 'your', 'yours') and recognize the importance of protecting the information collected about them. You are legally liable for theUser Content that you submit including, for example, material protected by copyright, trademark,patent or trade secret law or other proprietary rights laws without permission of the author orowner or subject featured in such submission, or defamatory comments.You grant to Company the worldwide, perpetual, irrevocable, royalty-free, fully-paid,non-exclusive, transferable right to use your uploaded User Content in any manner to bedetermined in the Licensed Parties’ sole discretion, including but not limited to on its webpages,social media pages operated by the Licensed Parties, promotional e-mails and advertisements,and in other marketing, promotional and advertising initiatives, in any media now or hereafterknown.You hereby represent and warrant that (i) you own all rights in and to your User Content, (ii) ifthe User Content is subject to third party proprietary rights, you have all necessary licenses,rights, consents, and permissions to publish the User Content you submit and to grant the rightsgranted herein, including permission from all person(s) appearing in your User Content; (iii) youare not a minor, (iv) you are legally entitled to post the User Content, and the Licensed Parties’use of your User Content as described herein will not violate the rights, including but not limitedto copyright, trademark, privacy, publicity or other proprietary rights, of any third party or anylaw, and (v) the User Content is not libelous, defamatory, obscene, pornographic, abusive,indecent, threatening, harassing, hateful, or offensive. You hereby release, discharge and agree tohold the Licensed Parties, and any person acting on their behalf, harmless from any liabilityrelated in any way to the Licensed Parties’ use of your User Content.The User Content that you submit is deemed non-confidential and the Licensed Parties have noobligation to maintain the confidentiality of any information, in whatever form, contained in anysubmission, except pursuant to the Licensed Parties’ respective privacy policies. By using theServices, you are consenting to Company’s collection of any personal information you providefor the Company’s use and disclosure in connection with the use of your User Content asdescribed herein. If you do not agree to the collection, use and disclosure of your personalinformation in this way, please do not use the Services or otherwise provide Company withpersonal information by contacting tinapearsonmarketing@gmail.com. Your personal information may betransferred to servers located outside the country in which you live or to ambassadors or othertrusted third parties based in other countries so that they may process personal information onCompany’s behalf. By using the Services or otherwise providing Company with personalinformation, you agree to such collection, use, disclosure, transfer and processing of yourinformation in accordance with the terms of these Terms, the Privacy Policy and applicable dataprotection laws and regulations.



Company reserves the right to remove any User Content from the Site, the Brand properties andthe Services at any time, for any reason. If you believe User Content residing on the Site or theServices infringes a copyright, please refer to our Copyright Policy below.


HOW DO I WITHDRAW MY CONSENT?
